First Keys

Terms of Use

Draft last updated: September 30, 2026. This page (including the liability language below) was drafted by Claude as a reasonable starting point, not by a licensed attorney. It must be reviewed by a Michigan business/real estate attorney before you treat it as your final, binding Terms of Use. No website disclaimer — however well written — eliminates the possibility of being sued; it reduces risk and sets clear expectations, but it is not a substitute for proper legal review and adequate business insurance (see the note at the end of this page).

Educational purpose

First Keys provides general educational content about the homebuying process in Michigan. Nothing on this site constitutes individualized financial, legal, tax, or real estate advice, and no content should be relied upon as a substitute for advice from a qualified lender, attorney, tax professional, or licensed real estate agent regarding your specific situation.

No guarantee of outcomes

First Keys does not guarantee loan approval, program eligibility, specific interest rates, or any particular outcome from using this site's tools, content, or agent matching service. Calculators provide estimates only and are not loan offers or Loan Estimates.

Agent matching — independent agents, not First Keys employees

Requesting to be matched with an agent does not create any obligation for you to work with that agent, and does not guarantee the availability of any specific agent in your area. Participating agents hold an active Michigan real estate license; First Keys does not represent that participating agents have received any additional certification beyond standard licensing unless explicitly stated.

Any agent you are matched with is an independent real estate professional, operating under their own Michigan real estate license and their own brokerage — not an employee, partner, joint venturer, or agent of First Keys. First Keys does not supervise, train, direct, or control how a matched agent performs real estate services, and is not a party to the agency relationship you form with that agent or their brokerage. First Keys is not responsible or liable for an agent's conduct, advice, representations, performance, errors, or omissions. If you have a concern about an agent's conduct in a transaction, that concern should be directed to the agent's managing broker and, if appropriate, to the Michigan Department of Licensing and Regulatory Affairs (LARA), which licenses and regulates Michigan real estate professionals.

Accuracy of content; no warranty

First Keys works to keep its educational content accurate and current, and marks content that still needs verification internally. Even so, this site — including all text, figures, program descriptions, calculators, and market data — is provided "as is" and "as available," without warranties of any kind, express or implied, including warranties of accuracy, completeness, timeliness, or fitness for a particular purpose. Housing programs, interest rates, eligibility rules, and market conditions change, and content may be out of date by the time you read it. Always confirm specifics directly with a qualified lender, attorney, tax professional, program administrator, or your real estate agent before relying on them for a real transaction.

Intellectual property

Content on this site, including text, design, and downloadable guides, is owned by First Keys unless otherwise noted, and may not be reproduced for commercial purposes without permission.

Limitation of liability

The clause below is a reasonable starting draft, not advice tailored to your business — a Michigan attorney should confirm or revise the liability cap and carve-outs before you rely on it.

To the fullest extent permitted by law, First Keys, Ashten Tucker, and The Brand Real Estate will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or data, arising from your use of this site, reliance on its content, your interactions with a matched agent or lender, or any transaction you enter into — even if advised of the possibility of such damages. To the extent any liability cannot be excluded under applicable law, First Keys's total liability for any claim arising from your use of this site is limited to the greater of fifty dollars ($50) or the amount, if any, you paid directly to First Keys (not to a matched agent, lender, or other third party) in the twelve months before the claim arose. Nothing in these Terms limits liability where doing so is prohibited by law.

Indemnification

You agree to indemnify and hold First Keys and Ashten Tucker harmless from any claims, losses, or expenses (including reasonable attorneys' fees) arising from your misuse of this site, your violation of these Terms, or your violation of any law or third-party right.

Governing law

These Terms are governed by the laws of the State of Michigan, without regard to its conflict-of-law principles.

A practical note on liability, beyond this page

Website disclaimers like the ones on this page genuinely help — they set expectations, reduce ambiguity, and give you something concrete to point to. But they can't make a business un-sueable; anyone can file a claim regardless of merit, and a court decides whether a disclaimer actually applies to a given situation. Two things matter more than wording alone: getting this page (and the Disclosures and Privacy pages) reviewed by a real Michigan attorney, and carrying appropriate insurance — your existing Errors & Omissions (E&O) coverage as a licensed agent may or may not extend to a separate education/referral website like this one, so it's worth asking your E&O carrier (or a business insurance agent) specifically about that.
